AFA Action speaks out against Biden’s Title IX proposed regulations, slams DOE for ‘undermining the Constitution’

TUPELO, Miss. — Basic biology is under attack as the Biden administration continues to attempt to change the meaning of Title IX, the federal civil rights law that prohibits sex-based discrimination in any school or any other education program that receives funding from the federal government. The new proposed rules would expand the meaning of sexual discrimination to include gender identity, preventing schools and colleges from prohibiting transgender athletes from playing girls’ sports.

AFA Action, the government affairs affiliate of the American Family Association, is urging Americans to fight back against these unconstitutional rule changes and protect women’s rights to fair sporting activities and competition.

“While Republicans in Congress are working to pass laws protecting women’s sports from the obvious physical and biological advantage males have, the Department of Education is undermining the Constitution by attempting to legislate from the executive level,” said AFA Action CEO Walker Wildmon. “In a nutshell, President Biden and the DOE are threatening to withhold Title IX money that is designated to fund the education of America’s children. If they get their way, every public school in the country will be required to adopt policies that force girls’ and women’s athletic competitions to allow biological males to compete in order to get federal funding. We must confront this attack on natural law and biblical authority.”

“In 2021, I led the effort to pass Mississippi’s Fairness Act,” said Dr. Jameson Taylor, director of policy and legislative affairs for AFA Action. “This state law protects the integrity of women’s sports by prohibiting biological males from competing in female sports and on female sports teams. This effort was supported by 79 percent of Mississippi voters, including 83 percent of Independents and 65 percent of Democrats. The law allows a female student who is deprived of an athletic opportunity or who suffers harm to defend her rights in court.

“The Department of Education’s proposed changes to Title IX would completely circumvent Mississippi’s law, and other state laws like it, raising questions about whether federal education funds are being used to undermine state sovereignty. The proposed rule change will discourage girls from playing on their own teams. The changes will lead to the loss of playing time and scholarship opportunities for girls. The rule changes are coercive and a cynical and improper use of federal education funding to force the administration’s policy preferences on states.”
