Here is an important update. The South Carolina senate decided NOT to concur with the House version of H. 3924. You may have seen our previous action alert on that.
The House version of the bill banned the sale of intoxicating hemp, if it contains more than 0.4mg of total THC per container and does not contain cannabinoids synthesized or manufactured outside the cannabis plant. This is based on a new federal policy, set to go into effect in November 2026.
1) compromise to allow the sale of intoxicating hemp beyond the limits set by the House (and the federal government); or
2) kill the bill, which means keeping current loopholes allowing these products to be sold in South Carolina.
Contact your S.C. state senator and tell them: We want a full ban on intoxicating hemp. Not in liquor stores. Not in convenience stores. Not anywhere. And end the current loopholes allowing kids to get hold of these products.
Right now, in South Carolina, kids may legally obtain hemp-infused beverages. There is no age limit and no restrictions. This is bad and needs to be fixed.
But the way to fix it is not to allow the sale of intoxicating hemp beverages for adults. It’s to ban the sale of these items altogether, along with other cannabis-derived products.
Once the door is open to legal recreational cannabis use in South Carolina, it will be all the more difficult to stop medical marijuana, and then, recreational marijuana.
Please contact your S.C. senator today and tell them: “No intoxicating hemp. We want a full ban.”
