The United States Senate is considering Loren AliKhan's nomination to the United States District Court for the District of Columbia. Tell your senators to oppose this nomination.
Loren AliKhan believes the government should be able to interfere with a religious group's free exercise right to hire and fire its minister, a claim that the Supreme Court has unanimously rejected. In Hosanna-Tabor Evangelical Lutheran Church and School v. Equal Employment Opportunity Commission, AliKhan argued against the "ministerial exception" that allows religious groups to hire or fire a minister without state intrusion. In a 9-0 decision, the Court rejected AliKhan's position, calling it "untenable" and "hard to square with the text of the First Amendment."
Please urge your senators to vote against Loren AliKhan's confirmation.
Loren AliKhan's discriminatory hostility towards churches was also on display during COVID-19, when she tried to stop church services while enabling "defund the police" gatherings. In Capitol Hill Baptist Church v. Bowser, AliKhan argued that a church should not be permitted to gather outdoors, even though the church members had agreed to wear masks and to socially distance.
During a recent confirmation hearing, Senator Josh Hawley asked AliKhan why she discriminated against religious gatherings while enabling leftist groups of people to engage in open protests. She claimed "singing and other things" put a church at a higher risk for COVID-19 transmission. When Senator Hawley asked her why she put none of that scientific evidence in the record, she replied that the case was "fast-moving."
TAKE ACTION
Loren AliKhan has argued against religious freedom rights in other cases and is an openly hostile opponent of the constitutional rights of Christians. Her anti-constitutional advocacy should not be rewarded with a lifetime position to further her anti-Christian bigotry.
For these reasons, and others, please urge your senators to vote against Loren AliKhan's confirmation to the United States District Court for the District of Columbia.
