I frequently hear from callers who want to know if President Obama can be impeached. The answer, of course, is that constitutionally he can and should be.  

He took a solemn and sacred oath in the name of God that he would “preserve, protect and defend the Constitution of the United States.” He has not done so. 

The Constitution he swore to uphold requires him, in Article II, Section 3, to “take Care that the Laws be faithfully executed.” This he has repeatedly refused to do. He has refused to implement or defend DOMA. He has refused to uphold our immigration laws in Arizona and with illegal aliens of his choosing. He has refused to enforce federal drug laws in states where marijuana is legal. The list by now is virtually endless. 

So, yes, he has committed innumerable impeachable offenses. The Founders in their wisdom provided for checks and balances for every branch of government, even between elections, and impeachment is the power given to Congress to restrain an out of control executive branch. Impeachment is a perfectly constitutional remedy for a lawless president, a president who governs in open contempt of the Constitution and the rule of law. 

Will he be impeached? Of course not. The Republicans in the House don’t have the stones and the Republicans in the Senate don’t have the votes.  

Impeachment is the equivalent of an indictment, and requires just a majority vote in the House. With the current Republican majority in the lower chamber, that is a political possibility. After all, that same House voted decisively to hold Eric Holder in contempt of Congress. 

(And by the way, the Holder vote proves that Republicans can indeed cross the aisle. Seventeen Democrats voted with the Republicans on this one. Hooray for bipartisanship!) 

But an impeachment trial is not conducted by the House but by the Senate, and requires a two-thirds vote to convict. Ain’t gonna happen with the Senate still in the hands of a Democratic majority. 

Now that an irrational, illogical, stupendously mind-numbing and eye-crossing ruling has come down from John Roberts, unconstitutionally propping up the economy-destroying ObamneyCare legislation, it’s time to remember that the American people themselves possess the power of impeachment. It’s called an election. 

So while Congress will not exercise its power to remove Barack Obama from office, the American people can. 

The American people can electorally impeach President Obama, try him, convict him, and remove him from office, all on one glorious day: the first Tuesday in November. 

He can be placed in the dock, his numerous “high crimes and misdemeanors” against the Constitution, the law and the American people can be reviewed, and the American people can vote to convict and carry out the penalty of removal from office. 

If the GOP is looking for a slogan for the fall campaign, here it is: “November 6, 2012: Impeachment Day, USA.”
